Released 14 October 2022
Request:
Please provide me with an annual breakdown of the total number successful clinical negligence claims made against the trust in the maternity sector and the total value of the damages paid out in the maternity sector, broken down at a site-level.
I am specifically requesting the information at a site-level, not at the trust-level. That means the data you provide should be broken down by individual sites – e.g. separate data for a hospital the trust manages, as well as a midwife-led unit.
Please indicate if a site is a midwife-led unit i.e. freestanding from a hospital.
Please provide this data for the latest five years for which it is available.
The data could be provided to me in the format of two tables, one for total number of claims and a second for the total value of damages. Each row would represent a site, and each column would be a year.
Information disclosed:
University Hospitals Sussex NHS Foundation Trust has been in operation since 1 April 2021 following the merger of Brighton and Sussex University Hospitals NHS Trust and Western Sussex Hospitals NHS Foundation Trust.
Please note both legacy Trusts and the merged University Hospitals Sussex NHS Foundation Trust were/are members of the NHS Resolution (formerly NHS Litigation Authority) Clinical Negligence Scheme for Trusts (CNST).
NHS Resolution manage clinical negligence claims on behalf of NHS organisations and independent sector providers of NHS care in England who are members of NHS Resolution schemes. Payments for clinical negligence claims are paid directly by NHS Resolution. All Trusts’ claims data is collated and published online in Resolution factsheets
On the basis that NHS Resolution pay these compensation claims, the Trust would not hold complete information relevant to this activity. It is therefore appropriate in these circumstances that you contact NHS Resolution directly for the information you are seeking. The Freedom of Information service provided by NHS Resolution can be accessed. Should you still require information after contacting NHS Resolution, please let us know and we will be happy to consider what additional information we can provide.
