Released 2 September 2022
Request:
I would like to know the following information for the last ten years (1 April 2011 to 31st March 2022)
A) How much money was paid out by your Trust regarding claims brought in your maternity unit? Per year.
B) Out of the above claims (each year) how many related to:
- mothers dying
- babies dying
- stillbirths
- babies born with brain damage or cerebral palsy.
Information disclosed:
(A and B) Both legacy Trusts and the newly formed University Hospitals Sussex NHS Foundation Trust were members of the NHS Resolution (formerly NHS Litigation Authority) Clinical Negligence Scheme for Trusts (CNST) over the years relevant to your request.
NHS Resolution manage clinical negligence claims on behalf of NHS organisations and independent sector providers of NHS care in England who are members of NHS Resolution schemes.
Payments for clinical negligence claims are paid directly by NHS Resolution. All Trusts’ claims data is collated and published online in Resolution factsheets
On the basis that NHS Resolution pay these compensation claims, the Trust would not hold complete information relevant to this activity.
It is therefore appropriate in these circumstances that you contact the NHS Resolution Freedom of Information service directly for the information you are seeking. Should you still require information after contacting NHS Resolution, please let us know and we will be happy to consider what additional information we can provide.
